Acceptable Use Policy

We are pleased you have decided to become a Customer and we want you to enjoy the services we provide. In order to keep our service running smoothly for everyone, we have published this Acceptable Use Policy (AUP) to help define what constitutes an “acceptable practice” while using our service. Most of what follows is common sense, but we’d appreciate it if you took a few moments to read it anyway.

1. Illegal Activities

Illegal activities are prohibited. We cooperate with the law enforcement community and will help them investigate violations of the law that occur on our network. We also cooperate with investigations and remediation of violations of the Digital Millennium Copyright Act (DCMA), Can-Spam, and other appropriate requirements. We also respond to situations where Customer devices on our network may be infected with Malware or Viruses which are being used to attack other systems. We honor all lawful requests or subpoenas.

2. Prohibited Activities

Besides blatant illegal activities, negligence or deliberate behavior of a single subscriber should not generate problems for everybody else. To mitigate this, we monitor our systems for behaviors which may cause problems. We maintain a dynamic (not exhaustive) list of things that we know about and prohibit on our network. Please do not engage in any of these activities and help keep the network healthy for everyone.

You may not use your Email Service to send Bulk Email. “Bulk Email” means email messages of similar content that are sent to more than two hundred and fifty (250) recipients. Attempts to circumvent this restriction by breaking up bulk email over time, using multiple accounts, or other means will be a violation of this restriction.
Messages sent to users on a domain you own which is hosted on a DakotaPro email server are not considered Bulk Mail.

3. Unreasonable Use/Abuse

We design and deploy our resources to accommodate the expected normal uses of the services we provide. We also recognize that the definition of “normal use” is dynamic. Our management strategies include regular reviews of what constitutes “normal use” of our services. We use these reviews to help identify abnormal behaviors, particularly those activities that are causing undue strain upon the network or problems for neighboring subscribers. We reserve the right to take action in order to alleviate or mitigate unexpected, abnormal, or unreasonable use of our services, which may be identified through such reviews. Please do not abuse this shared resource and help us make sure everyone’s experience is great.

4. Violations

We hope that all of our customers will use their service in a safe, responsible manner. We also make a point to ask nicely that everyone refrain from behaviors that can cause problems for their communities. We also know that not everyone is partial to following the rules. Therefore, in order to protect ourselves and our subscribers, we will punitively enforce this AUP when necessary. Depending on the severity of the offense, we may assume a violator simply lacked knowledge that what they were doing is wrong. In such cases, we will try to educate the offender first. If the behavior continues (or the behavior is really bad), we will then take other measures to halt the behavior. Such measures can include billing network engineering time for remediation or eventually, account termination. Please do not let your actions cause these outcomes!
